TERMS OF SERVICE

1. SCOPE OF APPLICATION

These general terms and conditions apply in the version current at the time the contract is concluded for all business relationships between LiveSwiss AG (hereinafter: we or us) and its customers (you, you).

With the order of the goods or services, these conditions are considered accepted. Deviating conditions require a written confirmation from us.

2. CONTRACTUALITY

The presentation of the products in the online shop is not a legally binding application, but only represents a non-binding online catalog. If you only place products in the "shopping cart", this does not count as a binding order. You only place a binding order for the products in the shopping cart by clicking the "Order" button on the order page. We will then immediately send you a contract confirmation via email, upon receipt of which the contract is concluded. Acceptance is subject to legal admissibility and the availability of the goods or services ordered. Items that are temporarily not available must be reordered. The availability display in the online shop serves as information, not as a delivery confirmation, it can be inaccurate in exceptional cases. Price fluctuations for products due to crop or currency fluctuations are possible. The price stated at the time the contract is concluded is decisive.

3. DELIVERY AND SHIPPING CHARGES

We will deliver the goods you have ordered as quickly as possible to the address given in the order. In this case you will receive an information email informing you about the exchange. We are entitled to partial deliveries and partial services at any time, provided that these are reasonable for you. If partial deliveries are made by us, we will assume the additional postage costs. If you are not at home, we have the permission to simply deposit your delivery in front of your front door or in accordance with your deposit instructions, which you can leave when you place your order. Delivery is defined as “a delivery to your doorstep”. We only deliver into the apartment at the express request of the customer and assuming liability for any damage from incorrect manipulation or similar, ie we go through the front door to put the goods on the kitchen table, for example.

The stated price including the applicable statutory value added tax applies to all deliveries.

Pick-up point (Adora Vita, Ägeristrasse 8, 6300 Zug): orders are kept there for up to 24 hours. Orders that have not been picked up must be paid for.

4. RESERVATION OF TITLE, WITHDRAWAL FROM THE CONTRACT, CHANGES

We reserve ownership of the goods until they have been paid for in full. If you behave contrary to the contract, in particular if you do not meet your payment obligation despite a reminder from us, we can withdraw from the contract after setting a reasonable deadline and demand the surrender of the goods still in your possession. In this case we are entitled to dispose of the goods after we have received them back. We reserve the right not to enter into a contract in the event of a negative credit check. Desired delivery slots can only be changed up to a maximum of 2 working days before the delivery day.

5. DUE DATE AND PAYMENT

We only accept the payment methods indicated to you during the ordering process. The purchase price and any shipping costs incurred are due upon conclusion of the contract.

Vouchers will only be redeemed under the conditions indicated on the voucher. It is not permitted to sell vouchers or voucher codes without our prior written consent. When paying by means of a voucher, any remaining credit will be credited to the customer account and automatically offset against the next order. The accumulation of promotions, vouchers and discount codes is not possible.

6. WARRANTY AND LIABILITY

If the delivered goods are defective at the time of the transfer of risk, e.g. manufacturer's fault, or if a wrong delivery has occurred, we will, if possible, provide a replacement delivery or we will refund the damaged products. If the replacement delivery fails, you can demand that the purchase be canceled.

Our liability for our own fault as well as that of our employees, legal representatives and vicarious agents is limited to intent.

8. PRIVACY POLICY

We use the data you provide to fulfill and process your order. Your data will be passed on to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. Customer ratings only reflect the opinion of customers and do not necessarily agree with our opinion.

10. ALCOHOLIC DRINKS

Alcoholic beverages are not sold to young people under the age of 18. During the ordering process, the customer must confirm that he is 18 years of age or older. If this minimum age is not reached, the customer's offer will not be accepted and no contract can be concluded. The customer is obliged to provide truthful information about himself. Live Swiss reserves the right to request a copy of ID by fax or similar documents to determine the age without giving reasons. If your order includes goods whose sale is subject to age restrictions, we use a reliable procedure that includes a personal identity and age check to ensure that the customer has reached the required minimum age. The deliverer only hands over the goods after the age check and only to the customer personally.

11. RIGHT OF WITHDRAWAL

11.1 Consumers have the right to revoke the contract declaration within 48 hours of receiving the goods. The revocation must be sent in writing by email to info@liveswiss.com .

11.2 Cancellation of subscriptions and other orders: If a customer has set up a subscription, this must be canceled at least 5 calendar days before the next delivery. Unfortunately, it is not possible to cancel individual orders.

12. FINAL PROVISIONS

The provisions of the Swiss Code of Obligations apply. Zurich is the exclusive place of jurisdiction for all disputes that arise from a contract with Live Swiss. We reserve the right to change these general terms and conditions at any time.
